Charges – Arrested

A man in Washington was arrested after he allegedly shot and killed his neighbor for loudly revving a car engine outside his home. Presley Daniel Mileck, 50, appeared in court Wednesday, facing first-degree murder charges in the death of his neighbor, identified as Timothy A. Thomas, 39, in court documents obtained by Fox 12.

The incident is alleged to have occurred Tuesday outside Mileck’s home in the city of Battle Ground, Washington, after his wife Jocelyn called police around 2:30 p.m. to inform the neighbor by driving up and down the street, repeatedly revving his engine. She told police that Mileck left the residence to confront the man, but she heard multiple shots after her husband yelled at Thomas while she was still on the phone with authorities, according to court documents.

Jocelyn told authorities that her husband returned home “distraught and inconsolable” while he was holding a gun. She claimed that he made suicidal statements and was told by authorities to meet with officers at the end of his driveway after they became concerned for his safety. Agents from the Battle Ground Police Department responded to the home, near Alder Falls Road, around 2:45 p.m., and were approached by a man who said his wife had called about the disappearance of one of the her children.

Officers went to that man’s home and found Thomas unconscious on the ground after being shot several times. He was pronounced dead at the scene. While officers were at the scene of Thomas’s death, Mileck called his wife several times, and an officer eventually picked him up. Mileck reportedly told the officer that he “would like to cooperate and surrender peacefully.”

Court documents state that Mileck told the officer that he was sitting in the living room of his home and that he had placed the gun on the floor above his bedroom. Mileck then left the residence and was arrested by responding officers. Mileck reportedly told detectives during an interview at the police station: “I don’t know what I’m supposed to do. I don’t know if I need a lawyer or not.” Court documents say that he requested an attorney after reading his Miranda Warning.

A Clark County judge set Mileck’s bond at $ 1 million during his court appearance on Wednesday. He is scheduled to be formally arraigned on June 24.
